CONDENSED TOS
NOTICE: This is the CONDENSED version of the TOS.Detailed info may be missing. The sole purpose of this condensed version is for the Customer to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms, which WILL apply to your orders.

TERMS OF SERVICE
LAST UPDATE: 1.15.25This contract applies to the artist aka Seller and person or institution further called Customer purchasing from Seller a work of art further called Product. By ordering Product from the Seller the Customer agrees to the following terms and conditions:

ORDER PROCESS

PAYMENTS
1. You will be given 48 hours to pay after a sketch is shown or quote is given Non-payment within 48 hours will result in the product being cancelled. Progress up to that point, if any, will be re-purposed as a YCH.
1b. Customer agrees to pay the due amount upfront for any orders of value lower or equal to $50.
2. On orders above $150 customer agrees to pay half the invoice total upfront. The other half has to be paid on approval of the initial sketch.
2b. It is the customers responsibility to tell me when the payment has been sent.
3. Any other payment schedule has to be mutually agreed before work on the Product commences.
4. Customer accepts that work on the Product will not commence until payment has been received by Seller according to the above schedule.
5. PRICES CAN BE FLEXIBLE AND NEGOTIABLE!PRODUCT DELIVERY
6. Seller does not work with deadlines, do not rush the seller and please be patient unless discussed previously as intended product is needed for commercial or promotional purposes.
6b. Customer agrees that Product will be delivered digitally to email address provided by Customer, after the final payment has been received by the Seller.
7. Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Customer is obliged to bear any costs incurred by alternative delivery method, digital service subscription fees etc.
8. It is sole responsibility of Customer to propose delivery method which works for both parties. Seller cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.
8b. Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.REVISIONS
SELLER DOES NOT SEND WIPS UNLESS ASKED AFTER THE SKETCH PHASE
9. Customer has the right to 3 complete revisions in the sketching phase.
10. Customer has right to a reasonable amount of minor edits after completion, such as changing an eyecolour, fixing a small detail, or chainging body features. Any requests above that, except minor ones, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.
10b. If customer is unsure about the price please let the seller know! the seller can give a price estimate.
Once a price is negotiated there will be no price changes unless additons are addedCURRENCY CONVERSIONS
11. Customer agrees to pay the total amount specified in USD
12. It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller.
13. Payment is considered as received and completed only when total amount received on Seller's currency account is equal to the invoice amount in USD.CONTACT AND COMMUNICATION
14. Discussion of commissions can be conducted via the platform customer saw seller on, or Discord Chat, eggaltx3VISUAL REFERENCE GUIDELINES
15. Client must provide at least one clear and concise visual reference; please supplement the visual reference with any important information I may need to know to correctly draw the character.
16. If you link to a gallery or website of your character's artowrk, be sure that image/site will not fail later on, if I become unable to access the visual reference I cannot promise your product will be done with 100% accuracy.REFUND POLICY
17. Seller does not allow refunds of any purchased product.
18. Customer obliges to contact the Seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of Customer will be recognized as implicit approval of all work progress and current state of the prooduct which could lead to the product being pushed back on the priority list.PERSONAL AND COMMERCIAL USE
19. The Product received by Customer is for personal use. Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product.I, the artist, retain full and exclusive rights to the original artwork. The customer may not claim it as their own or use it for anything other than personal use, unless otherwise agreed upon.The client has my permission to repost the artwork wherever they would like, as long as proper credit is given (linked or tagged) and my watermark/signature remains intact and unaltered.
If you do not want me to post your commission online, you must tell me when you order.
PROHIBITED ACTIONS
• Altering my artwork in any way without asking for permission before hand, with the exception of cropping/resizing the image for an icon.
• Using my artwork as references for your own, whether tracing or re-purposing parts of the image.
• Claiming the artwork as your own.Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.CANCELLATIONS
20. Seller reserves every right to refuse or cancel any order, without giving reasons to Customer.
21. Any disrespectful behavior will not be tolerated and may result in a cancellation of the order. Seller will have full right to refuse any service to the Customer in the future.
If these terms are broken, you wil privately be blacklisted from commissioning me`
This TOS may be subject to change at any time without notice. Changes will not be applied retroactively.

Please keep my art style in mind when ordering; I wil not try to match another artist's or company's art style (example: Disney, Pokemon, etc)

I am a United States citizen and abide by United States laws.
Breaking this rule is extremely serious and will result in blacklisting/blocking on all social media, email, and any other means of contact. By ordering anything 18+/NSFW you are agreeing that you are at or above the age of 18.
